Legal
Terms & policies.
This page sets out the policies that govern our website and services: our Terms and Conditions, our Privacy Policy under the EU General Data Protection Regulation (GDPR), our Refund Policy and our Accessibility Statement. By using our website or services, you agree to abide by these terms and policies. If you do not agree, you should not use our website or services.
Terms and Conditions
These Terms and Conditions (“Terms”) govern your access to and use of the website fraxbit.com (the “Website”) and any services provided by FRAXBIT DIGITAL S.R.L., a company registered in Cluj-Napoca, Romania, VAT number RO47312025 (“fraxBIT,” “we,” or “us”). By accessing the Website or engaging our services, you confirm that you have read, understood and agree to these Terms.
If you use the Website or our services on behalf of an organization, you confirm that you are authorized to accept these Terms on its behalf. If you do not agree with any part of these Terms, please do not use the Website or our services.
Our Services
fraxBIT provides web design, web development, growth and digital marketing, AI integration and related digital services (together, the “Services”). The exact scope, timeline, deliverables and price of each project are set out in a written proposal or contract. If a proposal or contract signed with you differs from these Terms, the proposal or contract prevails.
Sending a message through a form on the Website, booking a call or receiving an estimate does not create a contract. A project starts only after a proposal or contract has been accepted in writing. Prices, estimates and examples shown on the Website are indicative.
Using the Website
You agree to use the Website only for lawful purposes. You must not attempt to disrupt or overload the Website, access areas that are not public (such as our administration area), submit false or automated form entries, or use the Website to infringe the rights of others.
Content and Intellectual Property
Unless stated otherwise, all content on the Website, including text, designs, graphics, logos and code, belongs to fraxBIT or its licensors. You may not copy, reproduce, distribute or create derivative works from it without our prior written consent. You may view and share links to the Website for personal or internal business use.
Our portfolio presents work we created for our clients. Client names, logos and trademarks belong to their respective owners and are shown only to describe our work. Ownership of the deliverables created in a project is governed by the proposal or contract for that project.
Subscriptions and Payments
Certain services are offered on a subscription basis (for example monthly or quarterly plans). Subscriptions renew automatically at the end of each billing period unless canceled at least 5 business days before the renewal date. Cancellation requests may be sent to contact@fraxbit.com.
Payments can be made by the methods stated in our proposal or invoice, such as bank transfer or card payments processed by third-party payment providers (for example Stripe or PayPal). We do not store card details. Late payments may result in the suspension of work or of access to deliverables until the outstanding amount is paid.
Service Specific Terms
- Growth and digital marketing: results depend on factors outside our control, so we do not guarantee specific rankings, traffic, leads or return on investment.
- Website design and development: work outside the agreed scope is quoted and billed separately.
- AI integration: AI systems can produce inaccurate output. You remain responsible for reviewing it before relying on it or publishing it.
- Third-party services: hosting, domains, licences, plugins and external APIs are subject to their providers’ own terms and fees.
- Refunds: except as set out in our Refund Policy, all payments are non-refundable.
Referral Program
Participation in our referral program is governed by the conditions published on the referral page, which form part of these Terms for referrers.
Disclaimer and Limitation of Liability
The Website and its content are provided “as is” for general information. We do our best to keep them accurate and available, but we do not guarantee that they are always complete, current or free of interruptions. To the extent permitted by law, fraxBIT is not liable for indirect or consequential damages, including loss of profit, revenue or data. Nothing in these Terms limits any liability that cannot be limited under applicable law, including the mandatory rights of consumers.
Indemnification
You agree to indemnify fraxBIT against claims arising from your breach of these Terms or from materials you provide to us that infringe the rights of third parties.
Links to Other Websites
The Website links to third-party websites and services (for example YouTube, WhatsApp, Google Calendar and Clutch). They are provided for convenience; we are not responsible for their content or practices, and you use them at your own risk.
Governing Law
These Terms are governed by Romanian law and applicable European Union law. Disputes will be settled by the competent courts in Romania, without prejudice to the mandatory consumer protection rules of your country of residence.
Changes to These Terms
We may update these Terms from time to time. The current version is always published on this page, with its date. Continued use of the Website after a change means you accept the updated Terms.

Privacy Policy (GDPR)
This Privacy Policy explains which personal data we collect through fraxbit.com, why we collect it, how long we keep it and what rights you have. It is written to comply with the EU General Data Protection Regulation (Regulation (EU) 2016/679, “GDPR”) and Romanian data protection law.
At a Glance
- We do not use cookies for visitors: no analytics, advertising or social media cookies.
- We do not use Google Analytics or any third-party tracking.
- We count visits with our own privacy-friendly statistics, without cookies and without storing your IP address.
- Messages you send through our forms are stored on our own server and delivered to our inbox.
- We never sell your personal data.
Who Is Responsible for Your Data
The data controller is FRAXBIT DIGITAL S.R.L., Cluj-Napoca, Romania, VAT number (CUI) RO47312025. For any question about your personal data or to exercise your rights, write to contact@fraxbit.com.
What We Collect and Why
Contact and project enquiry forms
When you send us a message, we collect your name, email address and message, and, if you choose to provide them, your company, the services you are interested in, your budget and your timeline. We also record the date and time, the page you sent the form from and which form you used (for example the menu or the contact page), so we understand which pages lead to enquiries.
We use this data to answer you, prepare a proposal and follow up on your enquiry. Legal basis: steps taken at your request before entering into a contract (Art. 6(1)(b) GDPR) and our legitimate interest in responding to business enquiries (Art. 6(1)(f) GDPR).
Referral program sign-up
When you join our referral program, we collect your name, email address and, optionally, your phone number and company, together with the referral code we generate for you, the page you signed up from and the date and time you accepted the program conditions. We use this data to run the program, attribute referrals and pay commissions. Legal basis: performance of the referral agreement (Art. 6(1)(b) GDPR) and our accounting and tax obligations (Art. 6(1)(c) GDPR).
Emails, messages and calls
When you email us, message us on WhatsApp or book a call through our Google Calendar booking page, we process the data you share in order to reply and to hold the conversation. WhatsApp and Google process that data under their own privacy policies.
Website statistics
To understand how the Website is used, we record the page you visit, the time of the visit, the website or campaign that referred you (for example a search engine or a link’s utm_source), and your device type (desktop, mobile or tablet). While a page is open, your browser also sends a short signal every 20 seconds so we can see how many people are on the Website right now.
To count unique visitors without cookies, we combine your IP address and browser details with a secret key into a one-way code that changes every day. Your IP address itself is not stored, the code cannot be reversed, and it cannot recognize you on another day or on other websites. Nothing is stored on your device. Known bots are excluded. Legal basis: our legitimate interest in understanding and improving our Website (Art. 6(1)(f) GDPR). You can object at any time.
Server logs
Like most websites, our server may record technical logs (IP address, date and time, requested page, browser type) to keep the Website secure and to fix errors. Legal basis: our legitimate interest in security (Art. 6(1)(f) GDPR). These logs are kept for a short period, normally up to 14 days.
Cookies
We do not set cookies for visitors and do not use similar technologies such as local storage to track you. That is why the Website does not show a cookie banner. The only cookie on the Website is a strictly necessary security cookie set when an authorized member of our team signs in to our private administration area.
When you follow a link to an external service, such as YouTube, WhatsApp, Google Calendar or Clutch, that service may set its own cookies under its own policy.
Who We Share Data With
We share personal data only with service providers that help us run our business:
- Google (Google Workspace): our email, used to deliver form messages to our inbox and to correspond with you.
- Our hosting provider: the server on which the Website and its database run.
- Accountants, legal advisers and public authorities: when needed for our legal obligations or to establish, exercise or defend legal claims.
We never sell your data or share it for advertising. If our business is reorganized, merged or sold, personal data may be transferred to the successor under the same protections.
International Transfers
Some of our providers, such as Google, may process data outside the European Economic Area. When they do, the transfer is protected by appropriate safeguards, such as the EU-U.S. Data Privacy Framework or the European Commission’s Standard Contractual Clauses.
How Long We Keep Your Data
- Enquiries that do not lead to a project: up to 24 months after our last contact, then deleted.
- Clients and referrers: for the duration of our relationship and afterwards for the periods required by Romanian accounting and tax law.
- Website statistics: up to 26 months. They contain no names, email or IP addresses.
- Server logs: normally up to 14 days.
How We Protect Your Data
The Website is served only over encrypted connections (HTTPS). Form submissions and statistics are stored in a database on our own server that is not publicly accessible. Our administration area is password protected, with signed sessions and limits on login attempts, and access is restricted to authorized team members. Our email runs on Google Workspace, which meets recognized security standards such as ISO 27001 and SOC 2. No system is completely secure, but we take appropriate technical and organizational measures to protect your data.
Your Rights Under GDPR
You have the right to:
- Access the personal data we hold about you and receive a copy
- Have inaccurate data corrected
- Have your data deleted (“right to be forgotten”)
- Restrict how we process your data
- Receive your data in a portable format
- Object to processing based on our legitimate interests, including website statistics
- Withdraw your consent at any time, where processing is based on consent
We do not make decisions about you based solely on automated processing, and we do not profile you. To exercise your rights, write to contact@fraxbit.com. We will reply within one month and may ask you to confirm your identity first.
You also have the right to lodge a complaint with the Romanian data protection authority (Autoritatea Națională de Supraveghere a Prelucrării Datelor cu Caracter Personal, dataprotection.ro) or with the authority in the EU country where you live or work.
Do You Have to Provide Your Data?
No. You can browse the Website without giving us any personal data. To answer your message or register you as a referrer, we need at least your name and email address.
Marketing Emails
We do not send newsletters or marketing emails unless you ask us to. If we ever do, it will only be with your consent, and every email will include a simple way to unsubscribe.
Children’s Privacy
The Website is intended for businesses and is not directed at children under 16. We do not knowingly collect personal data from children.
Changes to This Privacy Policy
We may update this Privacy Policy when our practices or the law change. The current version is always published on this page, with its date. For any question, contact contact@fraxbit.com.

Refund Policy for Digital Products
At FRAXBIT DIGITAL S.R.L., we take pride in delivering high-quality digital products and services. Because of the nature of digital goods (which can be accessed or downloaded immediately upon purchase), we maintain a strict no-refund policy in most cases. We believe in transparency about this policy, and we make it clear to customers prior to the completion of any transaction.
Our catalog includes digital products such as software, e-books, digital downloads, templates, and other cloud-based or downloadable content. Each digital product is designed for immediate delivery and use upon purchase.
Once delivered (via download or online access), digital products are considered used or consumable. For this reason, we generally cannot accept returns or offer refunds. In accordance with EU consumer protection law, you expressly acknowledge that once digital content delivery has begun with your consent, you waive the statutory 14-day right of withdrawal.
Except as expressly outlined below, all sales of digital products and services are final. We do not issue refunds once an order has been confirmed and the product has been delivered.
We strongly encourage you to review all product information, technical requirements, and available descriptions before making a purchase. If you have questions prior to purchase, our team is available at contact@fraxbit.com.
Exceptions: When a Refund May Be Considered
Although our standard policy is to not offer refunds, we recognize that exceptional situations may arise. Refunds may be considered in the following limited cases:
- Duplicate Purchases: If you accidentally purchase the same digital product more than once, please contact us. Upon verification, the duplicate charge will be refunded.
- Access or Delivery Issues: If a technical issue prevents access to the purchased product and we are unable to resolve the issue within a reasonable timeframe, a refund may be considered on a case-by-case basis.
All exception requests must be submitted in writing to contact@fraxbit.com and must include relevant order details and a clear description of the issue. All refund exception requests are evaluated individually. FRAXBIT DIGITAL S.R.L. reserves the right to approve or deny any refund request at its sole discretion.
Policy on Chargebacks
We strongly advise customers to contact us directly before initiating a chargeback with their bank or payment provider. Chargebacks are complex and time-consuming processes for all parties involved.
If a chargeback is initiated without prior communication and the transaction was properly authorized and fulfilled, we reserve the right to dispute the chargeback and provide supporting evidence to the payment processor.
Direct communication with our support team is always the fastest and most effective way to resolve payment-related concerns. By completing a purchase on our website, you confirm that you have read, understood, and agreed to this Refund Policy.
